End User License Agreement (EULA)

Please read this End User License Agreement ("Agreement") carefully before using the Dietly! ("Software") application. By installing or using the Software, you agree to be bound by the terms and conditions of this Agreement.

1. License Grant

The developers grant you a limited, non-exclusive, non-transferable, and revocable license to install and use the Software. The Software is primarily designed for healthcare and dietetic professionals. Personal use at your own risk is permitted, but the user bears all risks arising from such use.

2. Data Processing and GDPR (Privacy)

Dietly! is an "Offline-First" application. All recorded data – including patients' personal and health (biometric) data, dietary logs, and medical records – is stored exclusively on your device, using AES-256 industrial-grade encryption (SQLCipher).

  • You, as the user, are considered the Data Controller under the European General Data Protection Regulation (GDPR).
  • The developers of the Software have no access to the stored patient data in any form, do not collect it, and do not transmit it to external servers (cloud).
  • Proper backups (creating password-protected .ddb files) and the physical and software (antivirus, firewall) protection of the endpoint device are solely your responsibility.
  • The secure handling and transfer to the patient of unencrypted files consciously extracted by you from the Software (e.g., GDPR Data Export) also falls under your responsibility.
  • For legal, safety, and professional due diligence reasons, the Software logs – strictly locally and encrypted – to the patient's record if you override a configured allergen or preference warning. These local logs serve exclusively to substantiate your professional decisions.
  • Drafting the patient GDPR consent declaration (paper-based or electronic), ensuring its legal compliance, obtaining signatures, and uploading the scanned copy into the Software is solely your responsibility as the Data Controller. The Software serves merely as a secure, local digital archiving tool ("container"); the Software does not provide legal templates and does not verify the legal validity of uploaded documents. The developers and owners of the Software assume no liability for any legal, privacy, or financial consequences arising from the failure to fulfill these obligations.

3. Disclaimer of Liability (Medical and Professional)

The Software is provided on an "AS IS" basis, without any express or implied warranties.

  • Status of the Software: The Software is strictly a passive administrative and mathematical tool (platform) designed to significantly facilitate and improve the efficiency of professionals' work. The Software is not considered a medical device in a legal sense. It is not capable of, not intended for, and does not provide independent dietetic, medical, or health advice, nor does it provide diagnoses.
  • Professional Responsibility: The nutritional calculations provided by the Software (e.g., BMR, BMI, TDEE, macros) are based on recognized formulas and serve only as guidelines. The Software is not intended to, and cannot, replace the professional knowledge and expertise of specialists. The compilation of diets, determination of calorie goals, filtering of allergens, and assessment of health conditions are solely your responsibility as the user.
  • Built-in Database (Ingredients and Recipes): The ingredient and recipe database included in the Software is provided on a "best effort" basis. The developers assume no legal liability for the content, accuracy, or up-to-dateness of these data. The professional use and verification of this data are solely the responsibility of the dietitian (user). The Software provides full editing capabilities, allowing the professional to correct inaccurate data or add their own.
  • Accuracy of Allergen and Preference Data: The automated safety warnings are based solely on the allergen information recorded for the specific food item in the database. The developers assume no liability for missed warnings resulting from incomplete or inaccurate ingredient data. The accurate maintenance of allergens and the clinical verification of foods are always the sole responsibility of the dietitian (user).
  • Hardware Failure and Data Loss: The developers shall not be held liable in any way for data loss resulting from physical or logical hardware failure, operating system errors, or the lack of regular and secure backups. In the event of password loss, data recovery is technically impossible due to the nature of the encryption (AES-256).
  • Third-Party Components and Libraries: The Software utilizes third-party open-source encryption and database management libraries (e.g., SQLCipher). The developers assume no liability for any damages arising from potential bugs or vulnerabilities discovered in these external components.
  • Operational Continuity and OS Updates: The developers do not guarantee continuous, error-free, and uninterrupted operation of the Software across all third-party operating system versions or future updates.
  • Unqualified Use: The developers disclaim any and all liability for any errors, health damages, deficiencies, or incorrect diet compilations resulting from use by unqualified individuals (persons without appropriate dietetic or medical qualifications).
  • Exclusion of Damages: Under no circumstances shall the developers be liable for any direct, indirect, incidental, or consequential medical or financial damages arising from the use of the Software, data loss, or any potential software miscalculations. The user bears the entire risk.

4. Intellectual Property

The Software, including its source code, algorithms, unique user interface, logos, and graphical elements, is the exclusive intellectual property of the developers. Reverse engineering, modification, or unauthorized resale of the Software is prohibited.

5. Final Provisions

The developers reserve the right to unilaterally modify this Agreement during updates. This Agreement is governed by Hungarian law.
